Please read these terms and conditions carefully before using
this website. By using this website you will be deemed to have
agreed to be bound by these terms and conditions.
YOUR OBLIGATIONS
1. Tickets for events organised by Canterbury Festival can be
ordered via Third Party links that may be accessed through this
Website. You have to read the website disclaimer for more
information before ordering your tickets through these Third Party
websites.
2. Admission to Canterbury Festival events is only permitted
on production of an entrance ticket(s) unless otherwise expressly
advertised in relation to free events. Canterbury Festival
reserves the right to refuse admission, and to remove from the
Festival Enclosure, at its sole discretion, any person(s) whose
conduct is prejudicial to the safety and convenience of others, or
to the proper running of the Festival. We will not tolerate
aggressive and/or drunken behaviour under any circumstances. Should
this occur your admission will be refused and you will not be
entitled to a refund.
3. You represent and warrant that the Tickets are purchased
for personal use only and not for trade or commercial
purposes.
4. You will be responsible:
(i) for checking your ticket details and ensure that they are
correct and accurate;
(ii) for any loss, theft or damage to your Tickets;
(iii) to ascertain whether an event, performance or activity has
been cancelled and the date and/or time rearranged. If the event,
performance or activity is cancelled you will be offered Tickets
for the rescheduled time and date. We will use reasonable
endeavours to inform you of any cancellation once we have received
notification of the same. However it may not always be possible to
do so, for example due to changes happening at short notice;
(iv) to arrive at the event on time. Every effort will be made to
admit latecomers but admission cannot always be guaranteed.
(v) to comply with all relevant venue regulations including age
restrictions and safety announcements whilst attending the event,
performance or activity.
5. Unauthorised use of photographic and recording equipment at
any of the events, performances or activities is prohibited and any
tapes or films may be destroyed. These restrictions may vary
depending on the venues.
6. Restrictions may apply to mobile phones, pets (except
assistance dogs), and your own food and drink. It is your
responsibility to contact us to check if any of these restrictions
apply to the venue you wish to attend.
7. You will consent to the filming and/or sound recording of
any event, performance or activity as a member of the
audience. Should you have any concerns or objections in
relation to this you should inform us prior to the event.
REFUNDS AND EXCHANGES
8. We regret that tickets cannot be exchanged or refunded
after purchase unless the event is cancelled.
9. If an event is cancelled, ticket holders will be offered
tickets at any rescheduled event (subject to availability) up to
the face value of the tickets or, if the ticket holder is unable to
attend the rescheduled event or the event is not rescheduled a
refund of the face value of the ticket.
10. The promoter reserves the right to alter or vary the
programme of an event without being obliged to refund or exchange
tickets.
OUR LIABILITY
11. Our liability for losses you suffer as a result of us
breaking this contract is strictly limited to the purchase price of
the Ticket you purchased. This does not include or limit in
any way our liability for death or personal injury caused by our
negligence or for any fraud or fraudulent misrepresentation from
our part.
12. Persons attending Canterbury Festival events and using
Venue Car Parks, if available, do so at their own risks and
Canterbury Festival shall not be liable for any loss or damage or
for death or injury unless caused by the negligence of Canterbury
Festival.
SEVERABILITY
13. If any of these terms and conditions or any provisions of
a Contract are determined by any competent authority to be invalid,
unlawful or unenforceable to any extent, such term, condition or
provision will to that extent be severed from the remaining terms,
conditions and provisions which will continue to be valid to the
fullest extent permitted by law.
OUR RIGHT TO VARY THESE TERMS AND
CONDITIONS
14. We reserve the right to revise and amend these terms and
conditions from time to time to reflect changes in market
conditions affecting our business, changes in technology, changes
in payment methods, changes in relevant laws and regulatory
requirements and changes in our system's capabilities.
15. You will be subject to the policies and terms and
conditions in force at the time that you order your Tickets, or if
we notify you of the change to those policies or these terms and
conditions.
LAW AND JURISDICTION
16. These terms and conditions are governed by English law.
Any dispute arising from, or related to, such Contracts shall be
subject to the non-exclusive jurisdiction of the courts of England
and Wales.
DOMINANCE OF TERMS
17. In the event of any discrepancies the above terms and
conditions shall take precedence over those of Third Party websites
insofar as the ordering, purchase and use of Canterbury Festival
tickets are concerned.
